The BHR ACC Committee is diligently working within the rules of the covenants to enhance and bring the neighborhood up to the BHR covenant standards. The committee meets monthly and communicates often via email to review proposed construction plans and discuss current neighborhood compliance with our covenants. In effort to continue to educate each individual of the formal ACC process, we have detailed the steps for bringing a property into compliance below:

1. If a property is considered in violation per the BHR covenants, the owner will receive an “ACC Violation Letter”. Note: The COVENANTS REQUIRE the property owner to ADDRESS the violation WITHIN (14) DAYS of notification, before taking other actions as promulgated by covenant provision cited in Book 2197, page 553, paragraph 5. However, your BHR ACC ONLY REQUIRES you to RESPOND IN WRITING OR BY EMAIL to the BHR Facilities Manager as to HOW AND WHEN you will be addressing the issue WITHIN (14) DAYS of notification.

2. Failure to respond in writing within (14) days to the ACC will result in a “Second Request Violation Letter”. This letter will inform you of the date and time you are to meet with the Board to discuss the actual fine to be imposed, of up to $100 per violation, per day (NC General Statute 47F-3-107.1) .

3. Once a committee member is notified and has confirmed a violation is brought into compliance with the covenants, you will receive an “ACC Approval Letter”, thanking you for your effort and support.

If at any point you receive a letter regarding a covenant violation, it is imperative you respond within (14) days . Please respond by either writing a letter or sending an email to the ACC and/or the BHR Facilities Manager (Pat Snyder). We will be happy to work with each of you to resolve covenant violations when you respond (and follow through) with an action plan of how and when the violation will be addressed.

The committee will continue to examine the neighborhood for any obvious covenant violations. As a result, more ACC Violation letters will be sent to property owners requesting they come into compliance with the covenants we all signed and agreed to, when each of us made the wonderful decision of moving into Black Horse Run. Remember-- if you do receive a letter from the ACC, please immediately respond as requested.

We are also continually looking for “eyes” in the neighborhood. Therefore, if you see a potential violation you think should be addressed, please let us know. To those individuals who have already offered to help in assisting with the continued improvement of our neighborhood -- THANK YOU for your support!

As always, if a homeowner has a concern to be addressed by the Architectural Control Committee, please do not hesitate to contact our Chair, or any one of the committee members.
